Terms of participation
We want you to feel at home at 31DAYS from the very start. Our community is close to our hearts – and the participants feel it too: with an NPS of 72(!), we are one of the most popular mobility projects in Switzerland. Before we get going, here is the small print – short, fair and transparent, so that we all know where we stand.
The Net Promoter Score (NPS) is a measure of customer satisfaction. A score of 72 is considered top-class internationally and shows how much our participants value the 31DAYS experience and recommend it to others.
Version 1.3
1. Scope
These terms of participation ("Terms") apply to participation in the 31DAYS Challenge ("Challenge"), which is carried out on https://www.31days.ch by 42hacks mobility Genossenschaft, Berg 29, 9043 Trogen, Switzerland ("Company") on behalf of cities, cantons and partner organisations.
By taking part in the Challenge, the participant agrees to these Terms. If the participant does not agree to these Terms, they may not take part in the Challenge.
“I never thought I'd miss my car keys so little!”
2. Participation
Eligible to participate are all natural persons with legal capacity who:
- are resident in Switzerland (within the catchment area defined for the respective Challenge); or, exclusively in the context of the Basel Challenge, are resident in the cross-border catchment area (Lörrach area, Germany, or Saint-Louis area, France) and regularly commute into the Basel Challenge area; and
- own a private motor vehicle registered in their name or in the name of a household member (or have unrestricted access to one in their household), and
- hold a valid driving licence for the corresponding vehicle category; or
- live as household members in a household with a person who meets the above criteria and also takes part in the Challenge; and
- hold a SwissPass (this is mandatory in order to load the challenge GA onto it; a SwissPass can be obtained quickly and free of charge at https://www.swisspass.ch).
Number plates and registration:
For all Swiss Challenges, only private vehicles registered in Switzerland (Swiss number plates) are admitted. Foreign number plates are generally excluded; the only exception is private vehicles registered in Germany or France belonging to eligible commuters (from the Lörrach or Saint-Louis area) in the context of the Basel Challenge.
Excluded from participation are persons
- whose motor vehicle is registered to a company (company cars are generally excluded from participation).
- whose private vehicle has foreign number plates (except vehicles registered in Germany or France belonging to commuters in the context of the Basel Challenge).
- who are resident outside Switzerland and are not taking part in the Basel Challenge as commuters from the Lörrach or Saint-Louis area.
Participation in the Challenge is free of charge. The participant is obliged to provide all required data before the start of the Challenge and to register for participation. During the 31-day participation period of the Challenge communicated by the Company after registration, participants refrain from driving private motor vehicles. Excluded from this are all motor vehicles / services provided by the Company's partners as part of the Challenge.
Riding as a passenger in another person's motor vehicle is permitted in principle. Occasional use of the private vehicle for work assignments leads to the disqualification of the participants. Use of the company car for work assignments or for carrying out business activities does not lead to disqualification. Travel to and from the usual place of work is considered a private journey and may not be made with the company car either.
For example: a tradesperson may use their company car for the journey from the workshop to customers, but may not drive home from the workshop in the company car.
If the participant's vehicle is defective at the time of registration for the Challenge but is still registered, participation is possible. As soon as the car has been deregistered, participation is excluded. Taking part in the 31 Days Challenge more than once is excluded. The challenge GA can only be redeemed once per person. If it is redeemed again by the same person, the Company reserves the right to reclaim the costs of the re-redeemed challenge GA from the participants of the team concerned.
At the start of the Challenge, the participant must provide a copy of their vehicle registration document (or foreign registration certificate), a photo of the odometer reading and, where applicable, further evidence requested by the Company (e.g. proof of residence, proof of cross-border commuter status or commuter confirmation). To check that the respective private vehicle has not been used, participants also provide a photo of the odometer reading after the end of the Challenge and, where applicable, further evidence requested by the Company. If the mileage at the end of the Challenge (after 31 days) is more than 5 km higher than the mileage at the start, or if the photo of the odometer reading at the end is not uploaded, the Company reserves the right to reclaim the costs of the public transport passes received (e.g. challenge GA, Distripass or RegioCard Plus) from the participants of the team concerned. Emergencies are excluded from this, provided they are reported to us proactively no later than 48 hours before or after the event.
If a household with several persons owns several motor vehicles, all members of the household should in principle take part in the Challenge and refrain from using all of the household's motor vehicles. If, in justified exceptional cases confirmed by the Company, not all household members take part in the Challenge, the participant may not use any of the available private vehicles.
All 31DAYS participants receive questionnaires digitally before, during and after the Challenge. The survey results are evaluated anonymously and serve the further development of the project.
The organiser is entitled to disqualify or exclude from the Challenge participants who knowingly provide false information when registering, do not meet the terms of participation or have submitted their information too late. Places for participation in the 31DAYS Challenge are limited.
“31 days of freedom. My car is up for sale.”
3. Mobility services
During the participation period, in return for refraining from using motor vehicles, the participant is provided free of charge by our partners with the services described on the website or communicated separately ("Services").
The Services provided by the partners are subject to the partners' own general terms and conditions. The Company is not a contracting party to the agreement between the respective partner and the participant.
The participant is personally responsible for activating the public transport pass received (e.g. challenge GA, Distripass or RegioCard Plus) in good time and for holding a valid public transport ticket throughout the entire duration of the Challenge. In particular, attention must be paid to the correct start and end date of the public transport pass; compliance with these dates is the sole responsibility of the participant.
The participant is obliged to handle all items provided by the Company, such as vehicles, vehicle locks, bicycle trailers, etc., with care and to protect them against theft with appropriate security precautions. Accidents and any defects in the items provided must be reported to the Company immediately.
The participant acknowledges that statutory requirements or restrictions apply to the use of certain Services. The Company is entitled to check these requirements and, in particular, to request a driving licence where this is necessary for the use of the vehicles provided.
If the participant passes the vehicles entrusted to them on to their household members who also take part in the Challenge, the participant is responsible for checking the person's suitability to use the respective vehicle type. Passing them on to other persons is not permitted.
Additional offers, discounts and cashbacks: In cooperation with partners, the Company may offer participants special conditions, discounts or cashbacks on mobility offers (e.g. passes). In order to maximise the benefit for as many people as possible and to respond flexibly to partner agreements, the Company reserves the right to adjust or change these offers, their amount and their conditions at any time. The conditions valid at the time of the respective purchase or use always apply. Any claim to subsequent adjustment, compensation for differences or retroactive application of differing (earlier or later) offers is excluded.
Recourse to the courts is excluded, as is payment of the Services in cash. The Services cannot be transferred to third parties.
“The (e-)bike is much faster than my car ever was in city traffic.”
4. Discontinuation of the Challenge
The Challenge is considered discontinued if the participant's own motor vehicle or a third party's motor vehicle (e.g. neighbours, friends, family) is used. In this case, the Company must be informed, stating the reason. Emergencies are excluded from this.
In the event of discontinuation, all items provided must be returned immediately. The public transport passes received (e.g. challenge GA, Distripass or RegioCard Plus) expire on the day of discontinuation.
“Finally a reason to leave the car parked. We're keeping it up!”
5. Disclaimer
The Company's liability in connection with the Challenge is excluded to the extent permitted by law. The duties of care and liability provisions concerning the use of the items provided are set out exhaustively in the applicable general terms and conditions of the respective partners. The Company accepts no liability for the items or services provided by the partners or for their availability.
